HIV/AIDS Privacy Class Action

RK Litigation has commenced a proposed class proceeding against the University of British Columbia, the Providence Health Care Society, and Positive Living for unlawfully disclosing the HIV+ status of nearly eight-hundred residents of British Columbia. The disclosure occurred during the recruitment phase of a research study developed and executed by the defendants and was preventable with the use of even rudimentary security planning and oversight. The disclosure has devastated our client, causing him to suffer serious psychiatric injury.

Justice Warren Milman of the British Columbia Supreme Court has been appointed case management and trial judge for this action. We anticipate applying to the British Columbia Supreme Court to certify this action as a class proceeding under the Class Proceedings Act in early 2018.
